Intellectual Property and China

Following a recent trip to the Far East, Serjeants’ patent and trade mark attorney, Tim Cadman, reports on the intellectual property situation in China and explains the importance of protecting your IP rights:

China is an increasingly important country for businesses and inventors to Intellectual Property China, Tim Cadman, Serjeantsprotect their intellectual property. More patent applications are now filed in China than in any other country in the world. Serjeants has always been active in keeping up to date with the latest IP developments in China and we always ensure that we work with the Chinese attorneys that have the knowledge and skills to meet our clients’ needs. It was for that reason that I spent a week in Beijing in April of this year, meeting with the patent and trade mark attorneys with whom we cooperate with on a regular basis.

This was my fourth trip to China and I never cease to be amazed by the speed of progress in the country.

I am happy to say that China’s reputation as a place where IP infringement is rife and goes unpunished is a thing of the past. In recent years specialist IP courts have been set up to handle infringement cases and are providing reliable and cost-effective enforcement of patents, designs, and trade marks both for Chinese and foreign IP owners. In the most recent cases the damages awarded by these courts are now approaching the awards we see in the UK. On that basis, I would strongly recommend that anybody who has commercial dealings in China investigates the possibility of protecting their intellectual property rights in China.
