03 Apr Extension deadlines: support measures for IP applicants
At Serjeants, we deal directly with the UK Intellectual Property Office (UKIPO), European Patent Office (EPO), and the European Union Intellectual Property Office (EUIPO) on behalf of our clients. Here, we set out the support measures for IP applicants that each of these offices have implemented to assist those affected by the global coronavirus pandemic.
The UKIPO has declared the 24th March 2020 and all subsequent days as ‘interrupted days’ until further notice. This will be reviewed on 17th April and will then either be extended or the interruption will be lifted on 1st May. This means that all extendible deadlines are extended until at least 1st May. However, some deadlines and time periods cannot be extended by the UKIPO and therefore remain in place. To find out more please do not hesitate to contact us.
The EPO has announced that all extendible deadlines are extended until 17 April 2020. However, this does not apply to all deadlines. Some deadlines and time periods cannot be extended by the EPO and will, therefore, remain in place. If you are unsure whether or not you are entitled to this extension, we’d be happy to provide further guidance.
The EUIPO has announced that all deadlines falling between 9 March 2020 and 30 April 2020 will be extended to the 1 May 2020. It is worth noting that, as with the EPO, there remain some time periods that cannot be extended. To find out more about which deadlines this extension applies to, please get in touch.
With the rules changing from day to day, we would advise you adhere to original deadlines wherever this is possible. However, please do get in touch for some additional guidance on the status of a deadline or time period relating to any UK or European patent matter or to an EU design or trade mark matter. However complex or simple the subject matter may be, our approach is always the same: friendly, flexible and professional.
During these uncertain times, the team at Serjeants remains here to help. If you have any queries regarding the available support measures for IP applicants, or about any intellectual property matter, please call 0116 233 2626 or send an enquiry here.
